These Terms of Service ("Terms") govern your use of the website at liquidrc.com (the "Site") and any purchases you make from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are

"LiquidRC.com," "we," "us," and "our" mean LiquidRC.com, operating from 38 Spring St STE 3173, Nashua, NH 03061. "You" means the person using the Site.

2. Eligibility

You must be at least 18 years old to place an order. By placing an order, you represent that you are 18 or older and have the legal capacity to enter into a contract.

3. Acceptable use

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to our systems or accounts; (c) scrape, copy, or republish substantial portions of the Site without our written permission; (d) interfere with the operation of the Site; (e) use the Site to transmit malware, spam, or harassing communications.

4. Product information, pricing, and availability

We do our best to display accurate descriptions, images, prices, and stock counts, but we do not warrant that everything on the Site is free of errors. Prices and availability can change without notice. If we discover a pricing error after you order, we will contact you before charging your card; you may then confirm the order at the corrected price or cancel.

Stock counts shown on product pages are live but not guaranteed. If an item sells out between the moment you order and the moment we pick it, we will contact you to substitute or refund.

5. Orders and payment

Placing an order is an offer to buy. We accept your offer when we ship the order. We may decline or cancel any order at our discretion, including for suspected fraud, address problems, or unavailability.

Payment is processed by Stripe through Snipcart. We do not see or store full payment card numbers. You authorize us (and our payment processor) to charge your payment method for the order total including tax and shipping.

6. Sales tax

We collect sales tax in states where we are required to. The tax amount appears at checkout before you complete your order.

7. Shipping and returns

Shipping is covered by our Shipping Policy. Returns are covered by our Returns Policy. Both are incorporated into these Terms by reference.

8. Warranties and disclaimers

Most products we sell are covered by a manufacturer warranty; warranty claims should be made through the manufacturer using the process described in the product's manual.

Other than that manufacturer warranty and our Returns Policy, the Site and the products on it are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, LiquidRC.com is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or related to your use of the Site or any product purchased from us. Our total liability for any claim is limited to the amount you paid for the product or order giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify and hold LiquidRC.com harmless from any claim or demand, including reasonable attorneys' fees, brought by a third party arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

11. Intellectual property

The Site's text, images, logos, layout, and code are owned by LiquidRC.com or our licensors and are protected by copyright and other intellectual property laws. Product brand names, logos, and trademarks shown on the Site belong to their respective owners and are used to identify the products we sell.

12. Third-party links

The Site may contain links to third-party websites. We do not control those sites and are not responsible for their content or practices. Visiting them is at your own risk.

13. Changes to the Site or these Terms

We may change the Site or these Terms at any time. When we change the Terms, we will update the "Last updated" date above. Continued use of the Site after a change means you accept the revised Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Hillsborough County, New Hampshire, and you consent to the jurisdiction of those courts.

15. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force.
